The applicant needs to be a refugee in order to engage in Australia’s protection obligations. This visa allows visa holders to apply for protection and live in Australia permanently.
Recognition as a refugee under Australian law
Applicants must demonstrate that there is a real possibility of them facing persecution on account of their:
- nationality
- religion
- race
- political opinion
- membership of a particular social group
Recognition for complementary protection by Australia
Applicants must prove that their removal from Australia to their home country will put them at the real risk of the following forms of significant harm:
- arbitrary deprivation of life
- the death penalty
- torture
- cruel or inhuman treatment or punishment; and/or
- degrading treatment or punishment

Applicants for this visa:
must have arrived in Australia on a valid visa and be immigration cleared on arrival
must meet the necessary identity requirements and be able to provide documents as evidence of their identity, nationality or citizenship with their application if asked
must not be barred from lodging a protection visa application
meet the relevant character and health requirements
must not have held Temporary Protection visa (subclass 785)/Temporary Safe Haven visa (subclass 449)/Temporary (Humanitarian Concern) visa (subclass 786)/Safe Haven Enterprise visa (subclass 790)
